Welcome to Bail! This End User License Agreement (the "Agreement") is a legally binding agreement between you (the "User" or "You") and the developer(s) of Bail ("we", "us", or the "Developer") regarding your download, installation, registration, and use of the Bail - Dance Community application (the "App" or "Bail").
1.1 By downloading, installing, registering, or using the App, you acknowledge that you have fully read, understood, and agree to be bound by all the terms of this Agreement. If you do not agree to any term of this Agreement, please cease using the App immediately.
1.2 We reserve the right to modify the terms of this Agreement at any time. Updated agreements will be posted within the App, and the "Last Updated" date will be changed accordingly. Your continued use of the App after such modifications constitutes your acceptance of the modified Agreement. We recommend that you review this Agreement periodically.
2.1 To use the App, you must register and log in to an account. The App currently supports registration exclusively via "Sign in with Apple." You are responsible for the accuracy of your registration information and for maintaining the security of your account.
2.2 You are solely responsible for all activities conducted under your account, including any content you post or messages you send. You agree to notify us immediately of any unauthorized use of your account.
3.1 Bail is a content community and learning platform for dance enthusiasts. The App provides a space for users to access basic dance tutorials, share practice videos, browse content from other dancers, and communicate privately with other users. Content is primarily user-generated, and the platform provides simple creation tools and interactive features.
4.1 The App offers optional in-app purchases ("IAPs") to enhance your experience. These are clearly marked within the App interface. IAPs fall into two categories:
4.2 All IAP transactions are processed through the Apple App Store. You agree to Apple's applicable payment terms. We do not handle or store your payment information. Prices are displayed in your local currency.
5.1 You retain ownership of the text, photos, videos, and voice recordings you create, upload, or post within the App (collectively, "Your Content").
5.2 You are solely responsible for Your Content. You represent and warrant that Your Content: (a) is original to you or you have all necessary rights and licenses to post it; (b) does not infringe upon the intellectual property, privacy, or publicity rights of any third party; and (c) is not unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, or otherwise objectionable.
5.3 You grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute Your Content within the App to operate and provide the services.
5.4 Community Guidelines: You agree to interact with other users respectfully. The App provides tools to report inappropriate content or block other users. We reserve the right, but are not obligated, to review and remove any content or suspend accounts that we believe, in our sole discretion, violate this Agreement or harm the community.
6.1 We are committed to protecting your privacy. Our data collection, use, and storage practices are detailed in the Bail Privacy Policy, which is incorporated into this Agreement by reference. Please read it carefully.
6.2 The App requests permission to access your device's camera, photo library, and microphone only when you choose to use related features, such as posting a video or sending a voice message. You control what you share.
7.1 The App, including its design, user interface, graphics, logos, the "Bail" name, and all software code, is the intellectual property of the Developer or its licensors and is protected by copyright and other laws. This Agreement grants you no right, title, or interest in any of the foregoing.
7.2 The pre-loaded dance course content (videos, text, images) provided within the "Learn" section is the property of the Developer or its licensors. Purchasing access grants you a personal, non-transferable license to view that content within the App. You may not copy, redistribute, or use it for commercial purposes.
8.1 This application and its content are provided "as is" and "as available." To the maximum extent permitted by law, the developer makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.2 The developer does not warrant that this application will be uninterrupted, error-free, or secure, nor does it warrant that any defects will be corrected. Dance involves physical activity. You use the tutorials and participate in any dance activities at your own risk. The developer is not liable for any personal injury or property damage resulting from your use of this application.
8.3 To the maximum extent permitted by applicable law, the developer shall not in any event be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data arising out of or related to your use of or inability to use this application.
9.1 This Agreement is effective until terminated by you or us. You may terminate it at any time by deleting the App from your device and ceasing all use.
9.2 We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach this Agreement.
9.3 Upon termination, your right to use the App will cease immediately. You may delete your account and associated data through the in-app functionality. Provisions that by their nature should survive termination shall survive.
This Agreement shall be governed by and construed in accordance with the laws of the country or region in which you reside, without regard to its conflict of law provisions.
